Terms of Use

These Terms apply to organizations that subscribe to SafeAlign ("Organizations") and to individuals who use the Service on behalf of an Organization or as authorized users (including administrators, supervisors, and workers whose data is entered into the platform).

SafeAlign provides tools to help Organizations manage occupational health and safety records, assessments, incidents, training, and related workflows. Features may change over time. We may suspend or discontinue any part of the Service with reasonable notice where practicable.

Organizations are responsible for maintaining accurate account information, safeguarding credentials, and controlling who accesses the Service under their subscription. You are responsible for activity that occurs under your account or credentials you issue.

You use the Service only for lawful purposes and in compliance with applicable occupational health and safety, employment, and privacy laws. You must not misuse the Service, attempt to gain unauthorized access, interfere with the Service or other users, or upload malicious code.

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you acknowledge that personal information may be processed as described there.

SafeAlign subscriptions are billed monthly or annually in Canadian dollars through our payment processor, Helcim. Subscriptions renew automatically unless cancelled before the renewal date. A 14-day free trial is available on all plans — no charge is made until the trial ends. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods except where required by applicable law.

The Service, including its software, branding, and documentation, is owned by FutureSafe or its licensors. You receive a limited, non-exclusive right to use the Service during your subscription in accordance with these Terms. You retain ownership of your content; you grant us the rights necessary to operate and provide the Service.

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. SafeAlign supports safety management and record-keeping; it does not replace professional judgment, legal advice, or compliance with all laws applicable to your organization.

To the fullest extent permitted by applicable law, FutureSafe and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our aggregate liability for claims arising out of or related to these Terms or the Service will not exceed amounts you paid us for the Service in the twelve months before the claim, except where prohibited by law.

You will indemnify and hold harmless FutureSafe and its officers, directors, and employees from claims, damages, and losses arising from your use of the Service, your violation of these Terms, or your violation of third-party rights, to the extent permitted by law.

We may suspend or terminate access to the Service if you materially breach these Terms or if required by law. Provisions that by their nature should survive (including limitations of liability, indemnity, and intellectual property) will survive termination.

These Terms are governed by the laws of Canada and the applicable province or territory, without regard to conflict-of-law principles, subject to mandatory consumer or other protections that cannot be waived.

We may update these Terms from time to time. We will post the revised Terms on this page and update the effective date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms where permitted by law.

SafeAlign includes an AI-powered help assistant. Responses generated by this assistant are for informational purposes only and do not constitute legal advice, professional safety advice, or a substitute for qualified occupational health and safety expertise. FutureSafe is not responsible for decisions made based on AI assistant responses. You should always consult a qualified safety professional for compliance and regulatory matters.

Upon termination or expiry of your subscription, your organization data will be retained for 90 days during which you may request an export. After 90 days, data may be permanently deleted. FutureSafe is not responsible for data loss resulting from non-renewal or termination of your subscription.

SafeAlign uses the following third party services to operate the platform: Helcim for payment processing, Supabase for data storage, Resend for email delivery, and Anthropic for AI features. Use of these services is subject to their respective terms and privacy policies. We take reasonable steps to ensure these providers meet appropriate security and privacy standards.
